On 6 February the State Duma has held a session of sea and river transport of the Expert Council under the state Duma Committee on transport and construction. The section is headed by the Deputy from United Russia Viktor Deryabkin. The meeting was also attended by members of the Section: Deputy of the Committee on transport and construction Paul Fedyaev (EP), Vladimir Sinyagovsky (EP), Sergey Sopchuk (EP), the Director of the Department of state policy for Maritime and river transport of Ministry of transport Yuri Kostin and in the faculty section.
Participants heard the final report of the chief Victor Deryabkin about the outcome of legislative work in 2018 and tasks for the spring session of the State Duma 2019, and then proceeded to consider the bill plan of the state Duma profile Committee on water transportation.
In terms of legislative work of the Section has initiatives to reduce the criminal liability of water transport at the same time with a tenfold increase in administrative. "In recent years, the accident rate on water transport has not decreased. In 2016 year, there have been 88 accidents in 2017 is 89 accidents. The reason for 84% of accidents is human factor," such statistics led the Victor Deryabkin. In the discussion the participants were divided: some believe that an endless increase, even of administrative punishment is the wrong way, others gave examples of when damage is a little overlap is impossible, as was the case with the bulk of the ship to the pier in the seaside trading port, where the amount of damage amounted to more than 2 billion rubles. The ship approached the berth at a speed three times more than.
In terms of the Section is planned to discuss the organization of a pilot security in Russia, the theme of the last six months has been widely discussed in the media. In the plan there is also a bill on simplification of the mechanism of realization of seized and confiscated and abandoned vessels that were used for illegal fishing.
Member of the scientific expert Council of the Maritime Collegium Alexander Balyberdin called a useful bill regarding the possibility of subsequent use of the removed soil during dredging. "Today it is forbidden, and any commercial use is a criminal offence. This bill should be supported, as it will move abruptly forward to self-sufficiency dredging if the merchant see that he can use this primer, including the fact that briquetting can then be used in agriculture.
Controversial legislative initiative to determine the liability of operators of marine terminals for the excess load on the axle of the vehicle during the loading of the cargo at the port. The work on the bill was the Director of government relations, OOO "Management Company global ports" Dmitry Morozov.
The bill has been discussed for a year and a half. Now the law imposes legal responsibility on the operators of sea terminals, however, the operator of a port terminal is not the owner of the cargo and could not effectively influence either the cargo or the shipper. In conjunction with the Department of sea and river transport, we propose a mechanism of accountability is similar to that for verification of IMO cargoes in containers.
During the discussion, Executive Director of ASOP Serik Zhusupov said the basic principle should be the responsibility of the one who violates. The expert gave an example, when the carrier is in the pursuit of profit violates all that is possible and impossible, which ultimately leads to the risks of road safety.
"Deputies will simplify some procedures and reduce duplicative regulations for vessels of the Russian flag. In terms of the Section there are a number of issues that require eliminating redundant requirements of the Russian legislation, not by Treaty. In the current situation to the courts of the Russian flag is brought twice as many standards and different requirements, which puts them at a disadvantage with vessels of foreign flags. This significantly reduces the competitiveness of vessels under the Russian flag, and in this area the deputies in the near future will be actively working with the Russian chamber of shipping to remedy the situation. We are talking about the duplication of norms of the international code of security of ships and of port facilities and the provisions of the law on transport security, the requirement of the state environmental expertise for the transportation of certain goods, elimination of contradictions of norms of the international Convention of 2006 on Maritime labour and labour legislation (law on population employment in the Russian Federation and the Labour code) regarding the rights of ship-owners on the conclusion of labour contracts with the members of the crews, as well as eliminating redundant requirements on the availability of financial support, etc.," commented to Morvesti.Ru following the meeting, the Deputy of the Committee on transport and construction Paul Fedyaev (EP).
