In accordance with the law of the Russian vessels fishing in the exclusive economic zone and (or) on the continental shelf of the Russian Federation in respect of which carried out border and customs control, can repeatedly cross the State border without passing border, customs and other controls for passage through the territorial sea of the Russian Federation for the transition from one fishing area to another, subject to notification of boundary bodies about intention to cross the State border and transfer to the border authorities of the data about the location of such courts. The passage through the territorial sea must be continuous and expeditious.
Rules notice boundary bodies about intention to cross frontier of the Russian vessels engaged in fishing in the exclusive economic zone and (or) on the continental shelf of the Russian Federation, and rules of the transmission to border authorities about the location of such vessels when passing through the territorial sea of the Russian Federation established by the Government of the Russian Federation.
However, the bill establishes the types of fisheries, which will be subject to the proposed regime.
The purpose of this bill is to align the economic interests of the state owner of the resources and organizations, citizens and legal entities–users of resources.
The bill is supported by the Ministry of fisheries of the Kamchatka territory's Agency for fishery in Sakhalin region.
The explanatory Memorandum States that in the previously existing law had not settled the question of crossing the State border of the Russian Federation with the purpose of passage through the territorial sea of the Russian Federation fishing vessels in respect of which carried out border and customs control, the transition from the fishing areas in the sea of Okhotsk in the fishing areas of the Northern Kuril Islands, Eastern Kamchatka and the Bering sea. Fishing vessels have no possibility of passage through the First Kuril Strait forced to follow through the Fourth Kuril Strait.
The distance traveled by ships across the First Kuril Strait from entering the territorial waters of the Russian Federation in the sea of Okhotsk through them in the Pacific ocean, 29 miles, where it passes through the Fourth Kuril Strait to bypass the Islands of Shumshu, Atlasova and Paramushir beyond the territorial waters up to 230 miles.
Only for the first half of 2015 court fishing companies of Primorsky Krai were forced to come this way in 59 times. The practice of using the First Kuril Strait to transit passage of fishing vessels in previous years showed that, provided they notify the border authorities the effectiveness of such a transition is very high.
