Material posted: Publication date: 12-09-2019
In April this year in Moscow the Analytical centre under the Government of the Russian Federation held the IV all-Russian forum of port "port Infrastructure: construction, reconstruction, modernization", organized by the magazine "Sea ports" with the support of the Association of sea commercial ports (ASOP), Rosmorrechflot and Rosmorport. The Forum was attended by over 100 participants representing the Federal bodies of Executive and legislative power, design, construction, operational, research enterprises and organizations of the Maritime industry, financial and educational institutions, public associations and unions. As noted by the forum participants, the conference venue at the site of the Russian Government justified and symbolic. The pooling of resources and interests of the state and business in development of this important segment of the economy and of the transport complex is of great importance. Not accidentally, the development of sea ports of Russia was given the status of a national project.

Greetings to the forum participants on behalf of the Deputy Minister of transport of the Russian Federation – the head of the Federal Agency of Maritime and river transport Yuri Tsvetkov asked his adviser Alexei Kravchenko. He noted that the cargo turnover of seaports of the Russian Federation, "perhaps the only macroeconomic indicator which is in the green zone for a quarter century, and this unique stability has made possible the great work and professionalism of port workers". Stressing that "to maintain momentum in the port sector requires new large-scale projects and new technologies, and new large investments, and therefore, a higher level of interaction between the state and business", he wished the participants of the energetic forum fruitful work, large projects and reliable partners.

Also announced was the Welcome address with a positive assessment of the industry and wishes the company continued success on behalf of the members of the state Duma Committee on transport and construction, deputies of the party "United Russia" Pavel Fedyaeva, Victor Deryabkin and Vladimir Sinyagovsky.

Executive Director, Association of sea commercial ports Serik Zhusupov noted the unprecedented pace of development of industry, port infrastructure, cargo ports, and pointed to new tasks set before the branch of government in national projects.

Regulation of the port industry

Deputy Director of Department of state policy in the field of Maritime and river transport of Ministry of transport of Russia Boris French said that the Ministry on a regular basis work aimed at improving the legal regulation of the activities of seaports of the Russian Federation, which contributes to improve the efficiency of the port complex and its investment attractiveness.

In 2017 entered into force the Federal law "On amendments to the Federal law on sea ports", which took six years. In the framework of the implementation of this law has adopted a number of normative-legal acts. Today, the Ministry of transport prepared and approved by the government Rules for the preparation and adoption of a decision establishing the sea port, the Rules of establishing and changing the boundaries of the territory of the seaport and expansion of the seaport, the List of infrastructure objects of a seaport, the Criteria are the inextricable links of the infrastructure of the seaport, the Order of rent of Federal property, located in the sea port, and being under the economic jurisdiction of the Federal state unitary enterprises subordinated to Rosmorrechflot.

Office work and on other important directions of increase of efficiency of the port industry. In particular, the results of the transport analysis of the competitive environment, the government approved the Plan of measures on development of competition in 2018-2020, in "Water transport" which includes measures to amend the decree of the Government of the Russian Federation No. 293, providing for the termination of regulation of prices for services of natural monopolies in sea ports for the provision of moorings, provision of pilotage services, tug boats, to ensure environmental safety in the port, passenger service in the marine terminals, providing services of loading, unloading and storage of goods, with the exception of ports handled oil and oil products, delivered via the pipeline system, as well as for services of natural monopolies in the river ports.

As noted B. French, in March of this year, all comments and suggestions of the Ministry of transport were taken into account of the FAS of Russia and was included in the revised draft decree, which will soon have to be government approved.

Details of a Comprehensive plan for the modernization and expansion of trunk infrastructure for the period until 2024 as part of the development of sea ports opened by the Deputy head of the Department of seaports and development of infrastructure of the Federal Agency of Maritime and river transport Roman Katunin. According to him, this Federal project is implemented on the principles of project management. For this purpose, the government, the Ministry of transport and Rosmorrechflot set up the relevant project offices.

In the framework of the Federal project "Sea ports", included in the national priorities of the state identified in the may decree of the President of the Russian Federation, capacity of Russian seaports is expected to grow to 1.3 billion tons. The largest increase is planned in the ports of far East pool – more than 125 million tonnes (major projects in the ports of Vladivostok, Vostochny, Vanino, Zarubino, in the ports of Sakhalin, etc.). On the second place of the Azov-black sea basin – increase in capacity over 100 million tons (development projects of terminals in Novorossiysk, the construction of dry cargo district of port Taman). The big development receive ports of Ust-Luga, Murmansk, Kaliningrad (draft terminals "Logoport", "Lavna", "Pioneer").

Project approach to the management of Federal projects in the Comprehensive plan for the modernization and expansion of trunk infrastructure for the period up to 2024, said the Deputy General Director for project management of the FSUE "Rosmorport" Boris Tashimov. Administration of projects in the area of responsibility of Rosmorrechflot assigned to the project office of FGUP "Rosmorport". As the speaker stressed, the main task when creating the project office was to ensure monitoring and administration of Federal projects in the Comprehensive plan.

At the moment the project office of "Rosmorport" is planning – according to the guidelines of the Analytical center, for each of the activities included in the Federal project needs to develop a detailed schedule, and in accordance with the principles of project management necessary scheduling and resource planning. Now "Rosmorport" approached the stage of reporting on the implementation of the Federal project, the achievement of the key target points on the financial indicators.

The Chairman of the Committee of investment programmes of port infrastructure development and operational issues of ASOP Dmitry Morozov, speaking at the plenary session, told about a number of encumbrances, which hit the profitability of the stevedoring companies in the implementation of investment projects.

In recent times it has become a steady tendency encumbrance of port projects associated with the need for the construction of Federal property objects, which don't have enough funds of the Federal budget. Another negative point – the additional costs associated with the tax burden on the objects of checkpoints. In addition, the growing burden can be considered the need for the construction of the railway infrastructure both common and uncommon use on the approaches to port facilities and the need for construction and road infrastructure directly on the entrance to the port.

"What mechanisms are available now to solve these problems? This return on investment, which provide investors in the objects of the Federal ownership of the results of the project implementation, at the expense of port dues and rents in terms of Federal ownership, administered by "Rosmorport", – said Dmitry Morozov.

Concession and infrastructure mortgage – two more new term that has recently been actively discussed in the industry. Concession is the most viable option. As for the infrastructure of the mortgage – yet few people understand how to use it in the industry. According to Dmitry Morozov, not a single port project does not produce the cash flow which would provide a return of investment in port projects in need of additional implementation of the above encumbrances.

"It must be concluded that the investment climate in the industry has a tendency to tighten. And at the moment the implementation of the port investment projects is possible only in a more global financial flows and increasingly global economic processes related to foreign trade activities", – concluded the speaker.

In the plenary session about the plans and prospects of development of port infrastructure of the Far East told the Director of transport and logistics infrastructure investment projects Department of "Agency for the Far East to attract investment and support exports" Roman Sementsov and General Director of JSC "development Corporation of Kamchatka" Nikolay Pegin. The report "Investment in ecological infrastructure. Best available technologies in the field of environmental protection in seaports" were made by the Chairman of the Committee on ecology and environmental protection ASOP Dmitry Tarasov.

About the prospects of their ports in the development of international transport corridors "West – East" and "North – South" the General Director of JSC "Ust-Luga Company" Victoria Fedorov and the General Director of JSC "Port Lagan" (Republic of Kalmykia) Vitaly Duginov.

Port projects: management and financing

Expert session "Management of investment projects. Theory and practice" was opened by the report "Financing the preparation of infrastructure projects in the field of port infrastructure", first Deputy General Director of JSC "WEB Infrastructure" Dmitry Tvardovsky and "Financing of projects of construction of port infrastructure in the black sea region" Director of the Department of industry and transport of the black sea Bank of trade and development Leonid Sidorenko.

How to organize simultaneous work of all participants in the implementation of such a large and complex project like the seaport, said the group head of PPP and project Finance company Capital Legal Services Yulia Antipova. Since the tool of public-private partnerships increasingly heard in the context of the development of the port infrastructure, there is a request for structuring of the project.

In one project it is necessary to combine as the internal infrastructure facilities of sea port, and the external infrastructure, the speaker said. And those and others need to be split into 10 groups (including the General port facilities, freight terminals, border crossing points across the state border, artificially created land plots, road and railway access roads, external power grid, and other) in order to apply the 5 basic mechanisms for the establishment and financing within a single project (a PPP agreement, concession agreement, state contract, the agreement on cooperation with FSUE "Rosmorport" and the contract life cycle). Further, Y. Antipov told about the features of using these five basic mechanisms within a single project.

The implementation of concession projects in the port sector continued managing partner, head of practice for infrastructure and PPP Law firm "Kachkin and partners" Denis Kachkin. He told about the hidden challenges associated with the use of the concession mechanism in the field of port construction. "Port projects never structured through a concession. We came to the conclusion that no one fully understands, a concession for the port project or not. Because of such complex infrastructure projects in the concession still never Packed," said D. Kachkin.

He cited the example of one of the first concessions, which is currently implemented in the port of Lavna and which everyone referred to as basic models for port infrastructure. The speaker pointed out that the object of the concession agreement in the case of Launoy is not a coal terminal, and certain elements that "just can't be in private ownership".

"When we have both sides in this project, the state (the concessionaire – STLC, which belongs to the state), it is basically normal, the risks of this project is small, – said D. Kachkin. But let's imagine a situation, when the STLC will want to go out and sell this already created object to some investor. That will tell advisors of the investor who will offer to buy this terminal? They will say that there is a risk of requalification of the mode of the property of the concessionaire in the object mode of the agreement. This means that the property will become instead a public – private". In this situation what all this was started, is under great threat, concluded the Rapporteur.

On current issues of registration of rights to land plots on the territory of the sea port said the head of the Law Bureau "Stepanov and axuk" office GRATA in Rostov-on-don Igor Stepanov. He highlighted two key points in this area – the analysis of the positive and negative aspects of the decree of the RF Government dated 30.12.2018, No. 1775 "On approval of Rules for establishment and change of borders of territories of the port and expansion areas of the port" and considering it through the lens of applied practical experience of the law office in the sphere of land relations.

The speaker pointed to the complexity of enforcement procedures established by the Rules. First, despite the established algorithm for consideration of applications and the prescribed deadlines, the total period of consideration of applications is still very significant. Second, the procedure of observations, which is possible, not clear and not specified in the Rules. Third, the timing for approval by ministries and departments of the draft act of the Government of the Russian Federation is not determined by Rules, which entails another uncertainty with the timing of the project to the investor and detrimental to the investment climate of the region and the country as a whole. Fourth, the procedure for appealing against decisions and actions taken within the passage of specified procedures, not fitted; obviously, it needs to be shared, the lawyer concluded.

The conversation about infrastructure projects and their legal support continued partner "is designed to compensate for GKS" Vladimir Smolarz. He spoke about the relationship between customers and contractors during the execution phase, specific types of construction work, and especially with the peculiarities of relationships with foreign customers and contractors.

In the report, were considered, first, different legal systems and industry standards: choice of law; the predominance of the English legal categories; detailed specification of the legal and technical conditions. Second, financial performance security: Bank guarantee and parent company guarantee; insurance issues (accidents, environmental damage, destruction of the object). Third, the intensity of the circulation in the period of completion of works: changes in work progress and constraints. And fourth, the choice of arbitration.

The construction of hydraulic structures

Session on technologies of construction and reconstruction of port infrastructure, was opened by the head of projects of the scientific-technical group of Department of capital construction and repairs of the FSUE "Rosmorport" Alexander Ilchenko report "legal regulation of operation of port hydraulic structures, located in the economic management of the FSUE "Rosmorport".

Berthing facilities the main component of transshipment complexes, which play a key role in the system ensure the operation of sea transport, said the speaker. On balance "Rosmorport" berths are designed for processing virtually all types of cargo. There are currently 890 port facilities and facilities in 67 seaports with a total capacity of more than 1 billion tons. As of 1 January 2019 in the lease is more than 500 berths, which is about 75% of the total. Rosmorport interacts with more than 100 operators of sea terminals, the operating state of the CTA.

Touching upon the issues of technical regulation of the exploitation of marine GTS, Ilchenko emphasized that the activities of the "Rosmorport" is regulated by Federal laws, government resolutions, normative acts of the Ministry of transport of Russia and Rosmorrechflot. Thus, in fact, implemented a three-tiered scheme of regulations.

The existing enterprise system of technical control of the GTS in General compliance with the requirements of Technical regulations and GOST port GTS "Rules of examination and monitoring of technical condition". Ilchenko told about other documents and regulations that govern "Rosmorport" in their work.

Further on modern technologies and hydraulic construction projects said the technical Director of "Mordraga" Alexander Ivanyuk. As the speaker noted, the company has made proposals to implement the Comprehensive plan for the modernization and expansion of trunk infrastructure for the period up to 2024, namely: early involvement of the contractor; the use of modern equipment and technologies in the design and construction of large infrastructure projects; the development of the market of local suppliers.

Technology TenCate Geotube-based textile geoblock filled with sand in hydraulic engineering was presented by the marketing Manager of the company TenCate Geosynthetics Netherlands B. V. Mink Ter Harmsel. Geoblock TenCate can be filled in different ways – mechanically, hydraulically and manually. Laying geoblock is performed using hydraulic cranes equipped with lifting frames or wide spectacular mechanisms for overload.

Geosintetika TenCate equipment used in construction sites, in the construction of highways and Railways. When creating hydraulic and marine structures (marine structures, coastal protection) are used geocontainers with sand. The technology of laying of geocontainers worked out during the implementation of projects in many ports of the world.

On the possibility of reducing the cost of sheet piling for different types of GTS said the representative of LLC "Profile GF" Alexey Kalinin. The company, summing up 20 years of experience in the field of application of piles in hydraulic engineering, using foreign and domestic experience, has proposed a new type of piles. Originally they were called "wineries" sheet pile wall, subsequently became known as the Russian tongue and groove walls (RSC).

"On a number of projects proved that these walls provide significant savings, there are no serious demands on the geometry of piles, the quality of the weld, the weld can be made directly on the construction site, the RSC is a cost – effective alternative to the main trends of HZ-AZ, PSHS, SHTS", – said Alexander Kalinin.

TENSAR technology in the construction of new transshipment complexes in unfavorable conditions of soft soils were presented by the project Manager of the port infrastructure company "Tensar Innovative solutions", Igor Ostrovsky. The plants of the company "TENSAR" for the production of grids and lattices plastic geogrids, located in England, America and China. In 2014 opened a factory in St. Petersburg, before the materials were brought to Russia from England.

Geogrids and TENSAR geosynthetics are used for mechanical stabilization of the structural layers during the construction of the CTA and in artificial Armagrandi structures. Stabilization – unique mechanism of TENSAR geogrids: mechanical Zelinka of particles aggregate (sand, gravel, etc.) occurs in the hard cells of the geomaterial.

A presentation on "Complex corrosion protection of hydraulic structures" at the session was the lead sales Manager, OOO "AMBIT-TRADE" Vladimir Usov. The company "AMBIT-TRADE" for 20 years, is the exclusive representative of Sika and supplies to the Russian market under the brands Epiter, SikaCor, Betonol, Permacor, and Unitherm, designed for different purposes.

Practical experience of complex application of geosynthetic materials in the construction of hydraulic and coastal infrastructure shared the leading engineer of OOO "Husker" Andrey Fedotov. He noted that one of the important tasks in the construction of port infrastructure is a device bottom areas in the area of the piers for sea and river ports because of exposure to hydrodynamic water pressure from the propeller. To protect against erosion in such cases is widely used geosynthetic non-removable formwork – betonicifolia shell Incomat representing two paintings, United by vertical braces.

Another solution for the construction of port infrastructure, widely used worldwide, is a device of hydraulic technohub SoilTain – large size closed shells for the construction of highly reliable soil structures and strengthening the coastline Boone, breakwaters, piers, breakwaters, etc. Application technohub SoilTain company "Husker" as the core marine GTS has an obvious advantage – instead of costly riprap or concrete structures can be used in the local sandy soil.

A report on "the Use of materials and technology NGO "STREAM" objects of port infrastructure: soil stabilization, structural repair, waterproofing, corrosion protection of buildings and structures", the General Director of Scientific-industrial Association "STREAM" Andrey Glukhov.

Clay stabilizer "Acropol GS" dramatically changes the characteristics of cultivated soil and can be applied to devices of various types are the bases of roads of all categories, with the protection and strengthen the underground channels.

Communication and security in the port

The final session of the forum was devoted to innovative communication technologies and security at the port. The conversation was about how might look like a modern port, who is armed with innovative equipment and use in their activities the Internet and digital technology.

Presentation of supply to market products from company "trehjjd Logistik KOMPANI" made by Anton Kolesnikov, was called "Innovative technologies in port infrastructure. The Smart Port". The company supplies equipment for ports well-known manufacturers. Today in all ports of the Russian Federation has huge potential to increase turnover, productivity, and profitability.

As the speaker noted, the port of the future with "smart port" (Smart Port) is a technology for gathering useful information from equipment that is installed at the marine terminal. A wide range of products of Trelleborg, with the inclusion of sensors allows to collect information on vessel mooring (distance, speed and angle of approach are determined by the laser), the Parking lot at the pier, the departure of the vessel.

A conversation about communication systems in ports, in particular on the system of delivery of information through broadband wireless access (broadband wireless access), continued Vladimir Safronov, the representative of the company "InfiNet", one of the world's leading developers and manufacturers of equipment of broadband wireless access, ensuring sustainable communication channels for organization of access to the Internet, voice transmission in telephony and video streams in surveillance systems.

The report "port Security and optimization of insurance costs" was made by Cyril birch, Deputy General Director of "Panditrans", which is a network partner of TT Club – the leading global insurer, which provides services for risk management in transport and logistics. As the speaker noted, today the club insures 80% of the world fleet of transport containers (18 of the 20 largest shipping lines) and about 50% of the world's assets container handling (terminal and stevedore companies).

The experience and recommendations of the insurer suggests that 60% of all the potential risks that can be controlled from the terminal, and 39% of the risks associated with natural disasters can be monitored by the terminal. In addition, the club is working hard on the organization of preventive measures, and organizes seminars and trainings for civil servants and staff insured companies, publishes brochures and articles on risk management.

During the session were also made by the coordinator of the project "Marine policy" Center for strategic estimates and projections, member of the section of Maritime and river transport of the expert Council under the state Duma Committee on transport and construction Anna Gornova a report on "the Safety of navigation and ports state Maritime priority countries" and Chairman of Board of Directors GK "Engineering technology" with the report, "Maritime cyber security: challenges and opportunities".
